Tiavino SAS operates the website tiavino.shop and all related information, content, features, tools, products and services in order to provide you, the customer, with a curated luxury shopping experience (the "Services"). TIAVINO is powered by Shopify, which enables us to provide the Services to you.
TIAVINO designs and sells luxury contemporary earrings crafted with meticulous attention to detail, intended for discerning customers across Europe, Asia, and the United States.
The following terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
These Terms of Service are written in English. In the event of any conflict between the English version and a translated version, the English version shall prevail, except where prohibited by applicable mandatory law.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state or province of residence. You have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide in our store is correct, current and complete, and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 — OUR PRODUCTS
TIAVINO designs and offers a curated collection of luxury contemporary earrings. Each piece is crafted with high-quality materials and reflects a distinctive aesthetic that combines artisanal craftsmanship with modern design sensibility.
We have made every effort to provide an accurate representation of our products on the website. However, please note that colours, textures or product appearance may differ from how they appear on your screen due to the type of device and display settings you use to access the store.
We do not warrant that the appearance or quality of any products purchased will meet your expectations or be identical to how they are depicted in our online store.
All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products offered to any person, geographic region or jurisdiction, on a case-by-case basis.
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to our Refund Policy only.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. TIAVINO reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until TIAVINO sends you an order confirmation. We must receive and process your payment before your order is accepted.
In accordance with French consumer law (Article L221-14 of the Code de la consommation) and EU Directive 2011/83/EU, your order confirmation email constitutes the conclusion of the sales contract between you and TIAVINO. It will contain a summary of your order, the products purchased, the total price including taxes and shipping costs, and information regarding your right of withdrawal.
Please review your order carefully before submitting. TIAVINO may be unable to accommodate cancellation requests once an order has been accepted and processing has begun, except as provided under the right of withdrawal described in Section 8 below.
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address and/or phone number provided at the time the order was made.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
All prices displayed on tiavino.shop are quoted in Euros (EUR) by default. Prices may be displayed in other currencies for informational purposes only; the final charge will be made in the currency confirmed at checkout.
In accordance with applicable French and EU consumer law, all prices displayed to consumers resident in the European Union are inclusive of all applicable taxes (TTC — toutes taxes comprises), including VAT (TVA). Shipping costs are displayed separately at checkout prior to order confirmation.
For customers outside the European Union (including the United States and Asia), prices may be displayed excluding taxes and import duties. You are solely responsible for any customs duties, import taxes, or other charges levied by your country's customs authority.
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as set out in your order confirmation email.
We may offer, from time to time, promotional discounts on the Services governed by separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase and payment information for all purchases. You represent and warrant that: (i) the credit card or payment information you provide is true, correct, and complete; (ii) you are duly authorised to use such payment method; (iii) charges incurred will be honoured; and (iv) you will pay all amounts due, including shipping costs and all applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
TIAVINO ships worldwide, including to countries in the European Union, Asia and the United States. Delivery times and costs vary by destination and are shown at checkout prior to order confirmation.
In accordance with Article L216-1 of the French Code de la consommation, products will be delivered within the timeframe indicated during the ordering process. If no delivery date is specified, delivery will be made within a maximum of thirty (30) days from the date of order confirmation.
If TIAVINO fails to deliver goods within the agreed timeframe or within thirty (30) days, EU and French consumers have the right to cancel the order and obtain a full refund within fourteen (14) days of cancellation, subject to the exceptions provided under applicable law.
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, force majeure events, or other circumstances outside our reasonable control.
Once we transfer products to the carrier, risk of loss or damage passes to you. Title to the products passes to you upon receipt of your payment in full.
For international shipments, you are responsible for complying with all applicable laws of the destination country, including import regulations, and for paying any applicable customs duties, import taxes or fees.
SECTION 6 — PAYMENT METHODS
TIAVINO accepts major credit and debit cards (Visa, Mastercard, American Express), PayPal, and other payment methods as may be made available at checkout from time to time.
All transactions are processed securely via Shopify Payments or other authorised payment processors. TIAVINO does not store your complete payment card details.
In the event of payment fraud or unauthorised use of a payment method, TIAVINO reserves the right to cancel the associated order and notify the appropriate authorities.
SECTION 7 — INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, trade names, logos, text, displays, images, graphics, product reviews, video, audio, and the design, selection and arrangement thereof, are owned by Tiavino SAS, its affiliates or licensors and are protected by French, European, American and international intellectual property laws, including copyright, trademark and design rights.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.
Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a licence or other rights to you under any patent, trademark, copyright, or other intellectual property of TIAVINO, Shopify or any third party.
TIAVINO's names, logos, product and service names, designs, and slogans are trademarks of Tiavino SAS or its affiliates or licensors. You must not use such trademarks without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and slogans on the Services are the trademarks of their respective owners.
SECTION 8 — RIGHT OF WITHDRAWAL (DROIT DE RÉTRACTATION)
This section applies to consumers residing in the European Union (including France) and to other consumers where applicable law grants equivalent rights.
8.1 — Right to Withdraw
In accordance with Articles L221-18 et seq. of the French Code de la consommation and EU Directive 2011/83/EU on Consumer Rights, you have the right to withdraw from your purchase without giving any reason within fourteen (14) calendar days from the day on which you, or a third party designated by you (other than the carrier), take physical possession of the goods.
Where an order consists of multiple goods delivered separately, the fourteen (14) day period begins on the day on which you take physical possession of the last item.
8.2 — How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, you must notify us of your decision by a clear and unequivocal statement (e.g. a letter sent by registered post, or an email) to:

You may use the model withdrawal form set out in Section 8.4, but this is not obligatory. It is sufficient to send your withdrawal communication before the fourteen (14) day period expires.
8.3 — Effects of Withdrawal
If you validly withdraw from your purchase, we will reimburse all payments received from you, including standard delivery costs, without undue delay and in any event no later than fourteen (14) days from the day on which we receive the returned goods or evidence that you have sent them back, whichever is earlier.
We will carry out such reimbursement using the same means of payment you used for the original transaction, unless we have expressly agreed otherwise, and provided this does not incur any fees for you.
You must return or hand over the goods without undue delay and in any event no later than fourteen (14) days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods unless we have agreed otherwise.
Returned goods must be in their original condition, unused, unworn, and in their original packaging. We reserve the right to deduct an amount to reflect any diminished value of the goods resulting from handling beyond that which is necessary to establish their nature, characteristics and functioning.

8.5 — Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
· Goods made to the consumer's specifications or clearly personalised;
· Goods which are liable to deteriorate or expire rapidly;
· Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
· Goods which are, after delivery, according to their nature, inseparably mixed with other items.
SECTION 9 — LEGAL GUARANTEES (GARANTIES LÉGALES)
In addition to any commercial warranty TIAVINO may offer, consumers resident in France and the European Union benefit from the following mandatory legal guarantees, which cannot be waived or limited by contract:
9.1 — Legal Guarantee of Conformity (Garantie légale de conformité)
Pursuant to Articles L217-1 et seq. of the French Code de la consommation, Tiavino SAS is liable for any lack of conformity existing at the time of delivery of the goods and becoming apparent within two (2) years of delivery.
In the event of a lack of conformity, you are entitled to request repair or replacement of the goods. If this is impossible or would impose disproportionate costs, you may request a proportionate price reduction or rescind the contract, subject to the conditions set out in applicable law. You do not need to prove the existence of the lack of conformity during the twenty-four (24) months following delivery, unless proven otherwise or incompatible with the nature of the goods.
9.2 — Legal Guarantee Against Hidden Defects (Garantie des vices cachés)
Pursuant to Articles 1641 et seq. of the French Civil Code, Tiavino SAS is bound by the warranty against hidden defects in the item sold which render it unfit for its intended use, or which so impair that use that the buyer would not have purchased it, or would only have done so at a lower price, had they been aware of the defect.
In the event of a hidden defect, you may choose between returning the goods and having the full price refunded, or retaining the goods and having a portion of the price refunded. This action must be brought within two (2) years from discovery of the defect.
9.3 — Consumers Outside the EU
Customers outside the European Union may benefit from applicable consumer protection laws in their country of residence. The mandatory legal guarantees described in Sections 9.1 and 9.2 apply only to EU/French consumers. However, all customers are entitled to enforce any commercial warranty offered by TIAVINO.
SECTION 10 — RETURNS AND REFUNDS
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
In addition to any rights under our Refund Policy, consumers in the European Union retain the right of withdrawal described in Section 8 above. These Terms do not limit, restrict or otherwise affect any statutory rights you may have under applicable mandatory law.
SECTION 11 — OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over or input into. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion. We may also offer new features through the Services in the future, which shall also be subject to these Terms of Service.
SECTION 12 — THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you decide to leave our Services to access third-party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of third-party websites, or your purchase or use of any products, services, resources or content on such websites. Please review third-party policies and practices carefully before engaging in any transaction. Complaints or concerns regarding third-party products should be directed to the relevant third party.
SECTION 13 — RELATIONSHIP WITH SHOPIFY
TIAVINO is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Tiavino SAS. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TIAVINO, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TIAVINO.
SECTION 14 — PRIVACY POLICY AND DATA PROTECTION
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy, available at https://www.shopify.com/legal/privacy.
TIAVINO processes personal data as data controller in accordance with EU Regulation 2016/679 (General Data Protection Regulation — GDPR) and the French Data Protection Act (Loi Informatique et Libertés, as amended). Details of the data we collect, the purposes of processing, legal bases, retention periods, and your rights as a data subject are set out in our Privacy Policy.
As a data subject residing in the EU, you have the right to: access your personal data; rectify inaccurate data; request erasure; restrict processing; data portability; and to object to processing. You also have the right to lodge a complaint with the French supervisory authority, the Commission Nationale de l'Informatique et des Libertés (CNIL — www.cnil.fr).

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit may be transmitted to and shared with Shopify and third parties located in other countries. By using the Services, you acknowledge that you have read our Privacy Policy.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine, in our sole discretion, to be unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable, or in violation of any party's intellectual property or these Terms.
SECTION 17 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.
We undertake no obligation to update, amend or clarify information in the Services or on any related website, including pricing information, except as required by applicable law.
SECTION 18 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:

EXCEPT AS EXPRESSLY STATED BY TIAVINO, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
NOTHING IN THIS SECTION AFFECTS OR LIMITS THE MANDATORY LEGAL GUARANTEES TO WHICH CONSUMERS IN FRANCE AND THE EUROPEAN UNION ARE ENTITLED UNDER APPLICABLE LAW, AS DESCRIBED IN SECTION 9 ABOVE.
SECTION 21 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL TIAVINO SAS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.
NOTHING IN THIS SECTION EXCLUDES OR LIMITS TIAVINO'S LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; (C) ANY BREACH OF MANDATORY STATUTORY RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING THE MANDATORY CONSUMER GUARANTEES DESCRIBED IN SECTION 9 ABOVE; OR (D) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SECTION 22 — INDEMNIFICATION
You agree to indemnify, defend and hold harmless Tiavino SAS, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party due to or arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
This indemnification obligation does not apply to the extent that the loss, damage or liability arises from our own negligence, fraud or wilful misconduct, or from any breach of applicable mandatory consumer protection law.
SECTION 23 — CONSUMER MEDIATION AND DISPUTE RESOLUTION
23.1 — Amicable Resolution
In the event of a dispute arising from your purchase or use of the Services, we encourage you to contact us first at tet.bory@gmail.com so that we may seek to resolve the matter amicably. We will endeavour to respond within fifteen (15) business days.
23.2 — Consumer Mediation — France & EU (Mandatory)
In accordance with Articles L611-1 et seq. and L616-1 of the French Code de la consommation, as well as EU Regulation No. 524/2013 on online dispute resolution for consumer disputes, consumers residing in France and the European Union have the right to resort to a qualified consumer mediator free of charge in the event of an unresolved dispute.

23.3 — EU Online Dispute Resolution (ODR) Platform

SECTION 24 — GOVERNING LAW AND JURISDICTION
24.1 — General
These Terms of Service shall be governed by and construed in accordance with the laws of France, without prejudice to any mandatory consumer protection provisions of the law of your country of habitual residence that may apply.
24.2 — EU Consumers
If you are a consumer habitually residing in a Member State of the European Union, you may bring proceedings either in France or in the courts of your place of habitual residence, and you will benefit from any additional mandatory protections afforded by the consumer protection laws of your country of residence.
24.3 — Non-EU Consumers
For customers outside the European Union (including the United States and Asia), any dispute arising from or relating to these Terms that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
24.4 — US Consumers — Class Action Waiver
For customers located in the United States, to the extent permitted by applicable law, you agree that any dispute shall be resolved on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding. You and TIAVINO each waive any right to a jury trial.
SECTION 25 — TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) at any time, at our sole discretion, without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 26 — SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 27 — WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.
SECTION 28 — ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent.

We will notify you of any material changes in accordance with applicable law. For EU/French consumers, we will provide at least thirty (30) days' advance notice of material changes.
Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
